1. Introduction

Welcome to With You (“the App”, “we”, “our”). These Terms & Conditions (“Terms”) govern your access to and use of With You, including all features, content, and services provided through the App.

By downloading, installing, or using the App, you agree to these Terms.

If you do not agree, you must not use the App.

2. Eligibility

With You is available to users of all ages. Parents and guardians are responsible for supervising minors using the App.

By using the App, you confirm that:

• The information you provide is accurate
• You have permission to upload any content you share
• You understand these Terms apply to all users

3. Description of the Service

With You is a digital legacy and message-delivery platform that allows users to:

• Create text, photo, video, and voice messages
• Save messages as drafts
• Schedule message deliveries (once, annually, or posthumously)
• Add recipients
• Add emergency contacts
• Configure inactivity detection
• Use a multi-step posthumous verification system
• Release messages securely via deep links

The App does not provide legal, medical, or end-of-life advice.

4. User Accounts

To use most features, you must create an account.

You agree to:

• Provide accurate and complete information
• Keep your login details secure
• Not share your password with others
• Inform us immediately if you believe your account has been compromised

We may suspend or terminate accounts for violations of these Terms.

5. User Content

“User Content” includes:

• Text messages
• Photos, videos, voice notes
• Titles, descriptions
• Occasion selections
• Recipient information
• Emergency contact information
• Verification uploads
• Any media you submit through the App

You retain ownership of all User Content you upload.

However, by uploading content, you grant With You a limited, encrypted, permission-only license to:

• Store your content
• Process it securely
• Deliver it to your recipients under your instructions
• Use it only for the functioning of the platform

We do not share, sell, or publicly display your content.

6. Your Responsibilities

You agree that you will not:

• Upload unlawful, harmful, offensive, or abusive content
• Upload content that infringes copyright or intellectual property
• Impersonate another person
• Use the App for fraud, harassment, or malicious intent
• Attempt to bypass security measures
• Upload inappropriate or explicit content involving minors (immediate termination)
• Use automated tools to access or interact with the App

You are solely responsible for:

• The content you upload
• The accuracy of recipient and emergency contact data
• Ensuring your messages comply with applicable laws
• Any consequences of the content you schedule or release

7. Emergency Contact & Inactivity System

The "After I Am Gone" feature involves:

• Inactivity detection
• Notifications sent to your emergency contacts
• Document upload (e.g., death certificate)
• Second contact peer verification
• Admin verification
• Release of your messages

Important Notes:

• Emergency contacts must give consent to participate
• The verification system cannot guarantee 100% accuracy
• The App is not liable for incorrect verifications caused by miscommunication, fraud, forged documents, or wrongful confirmation/objection

Users are responsible for choosing trustworthy emergency contacts.

8. Message Delivery

With You delivers messages:

• On a chosen date
• Annually (repeat every year)
• After verified passing

Delivery is made via secure deep links.

We are not responsible for:

• Recipients not checking their email or SMS
• Recipients changing email/phone numbers
• Bounce-backs, spam filters, or network issues
• Mistaken delivery due to user error (wrong email/phone number)

9. Prohibited Content

You may not upload or schedule messages containing:

• Violence, threats, or abuse
• Hate speech or harassment
• Illegal activity
• Nudity involving minors
• Copyrighted material you do not own
• Fraudulent or misleading information
• Personal data of others without permission

Violation may result in immediate termination.

10. Intellectual Property

All trademarks, logos, visuals, and App code belong to With You. You may not: Copy or redistribute the App; Reverse engineer or modify the App; Use our trademarks without written permission.

11. Technical Requirements & Limitations

You understand and agree that: Media uploads may have file size limits; Delivery times may vary based on network conditions; Device compatibility may affect performance; With You may experience downtime for maintenance; We do not guarantee uninterrupted access.

12. Data & Privacy

Your use of the App is also governed by the With You Privacy Policy. By using the App, you agree that: Your data is processed securely; Your memories are stored encrypted; Your recipients and emergency contacts may receive your information when required; You may request account deletion at any time.

13. Termination

We may suspend or terminate your account if: You violate these Terms; You upload prohibited content; You misuse the App’s systems; Your actions endanger other users or the platform. You may delete your account at any time. Upon deletion: All scheduled messages will be cancelled; All content will be deleted permanently; This action cannot be undone.

14. Disclaimer of Warranties

The App is provided “as is”, without warranties of any kind. We do not guarantee: That the App will be error-free; That all messages will be delivered in all circumstances; That emergency contacts will respond accurately; That servers will always be available; That verification documents will always be correct. You use the App at your own risk.

15. Limitation of Liability

To the maximum extent permitted by law, With You is not liable for: Lost or undelivered messages; Incorrect emergency contact verification; User mistakes when entering recipient data; Loss of access to your account; Technical failures, outages, or delays; Actions taken by emergency contacts or recipients; Damages arising from your use of the App.

16. Indemnification

You agree to indemnify and hold harmless With You from claims, damages, losses, and expenses arising from: Your content; Your actions; Your breach of these Terms; Your misuse of the App.

17. Changes to These Terms

We may update these Terms at any time. If changes are significant, we will notify you through the App. Continued use of the App means you accept the updated Terms.

18. Governing Law

These Terms are governed by the laws of: Dubai, United Arab Emirates. Any disputes will be handled under UAE law.
